Summary

Its oversight information can go to other agencies, or to anyone the office authorizes.

The bill changes how the Health and Human Services Commission's inspector general office runs: it exempts the office's contracts for outside experts who review investigation findings from the normal state purchasing rules, and it lets the office share information from its oversight work with federal, state and local agencies and with anyone the office authorizes. It touches Medicaid providers, health care professionals, outside expert contractors and the agencies that receive shared information. In practice, expert-review contracts no longer go through standard bidding, the fraud hotline can be any 'appropriate communications system,' fingerprint checks yield to federal requirements, and two existing sections are repealed, starting September 1, 2025.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 544.0106, Government Code, as effective

April 1, 2025, is amended to read as follows:

Sec. 544.0106. PROCUREMENT OF CONTRACT FOR REVIEW OF

INVESTIGATIVE FINDINGS BY QUALIFIED EXPERT. Notwithstanding any

SECTION 6. If before implementing any provision of this Act

a state agency determines that a waiver or authorization from a

federal agency is necessary for implementation of that provision,

the agency affected by the provision shall request the waiver or

authorization and may delay implementing that provision until the

waiver or authorization is granted.

SECTION 7. This Act takes effect September 1, 2025.
