SB 2348
Alvarado Bill Lets Any Agency Rule Waive Its Medicare Requirement
Died in committee
Verdict: Smells
Why it's charged
The hole
The third exemption lets the health commission or any state agency write a rule excusing providers from the Medicare requirement, with no limit on whom it covers. The rule-making agency can shrink the new requirement as far as it likes, though the requirement still stands until it does.

Summary
No Medicare, no new Medicaid or CHIP. Third exemption: anyone a state agency rule names.
The bill says a doctor or other provider must be enrolled in, or certified for, Medicare before joining Texas Medicaid or the children's health plan program (CHIP). It reaches providers who have not been kicked out of Medicare, Medicaid or CHIP, and it exempts those whose services Medicare does not cover, those whose exclusion would cut patients off from needed care, and anyone a state agency rule exempts. Starting September 1, 2025, providers without Medicare enrollment are barred from new Medicaid and CHIP participation unless an exemption applies, and the state may wait on federal approval before enforcing it.
