Summary

No competitive bidding below the federal simplified acquisition threshold.

This bill lets certain city housing authorities skip competitive bidding on purchases unless the purchase costs more than the federal simplified acquisition threshold. It touches only the housing authorities described in a separate existing section of state law, Section 392.0162, and the vendors who sell to them. On the ground, more of those authorities' purchases can be made without competitive procurement starting with purchases on or after September 1, 2025.

A BILL TO BE ENTITLED

AN ACT

relating to procurement procedures for certain municipal housing

authorities.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter D, Chapter 392, Local Government

Code, is amended by adding Section 392.0566 to read as follows:

Sec. 392.0566. PROCUREMENT PROCEDURES FOR CERTAIN

MUNICIPAL HOUSING AUTHORITIES. Notwithstanding any other law, a

municipal housing authority described by Section 392.0162 is

required to comply with competitive procurement procedures

applicable to municipal housing authorities only when making a

purchase requiring the expenditure of an amount that is more than

the simplified acquisition threshold as defined by the Federal

Acquisition Regulation (48 C.F.R. Section 2.101) or a successor

regulation.

SECTION 2. The change in law made by this Act applies only

to a purchase made on or after the effective date of this Act. A

purchase made before the effective date of this Act is governed by

the law as it existed immediately before the effective date of this

Act, and that law is continued in effect for that purpose.

SECTION 3. This Act takes effect September 1, 2025.
