Summary

The comptroller negotiates discounts. Employers, schools and insurers can join.

The bill orders the state comptroller to set up a prescription drug buying pool that negotiates discounted drug prices with vendors. Insurers, HMOs, self-insured private employers, local governments, school districts, universities and quasi-public agencies can join to buy drugs for their workers, dependents and retirees, and they can also buy stop-loss coverage at a rate the comptroller negotiates. Each member still pays its own claims, joint buying through the pool is declared not to be a multiple employer welfare arrangement under the Insurance Code, and the comptroller writes the rules starting September 1, 2025.

Estimated Two-year Net Impact to General Revenue Related Funds for SB2857, Committee Report 1st House, Substituted: a negative impact of ($3,395,500) through the biennium ending August 31, 2027. The Health and Human Services Commission (HHSC) is required to implement a provision of the bill only if the legislature appropriates money specifically for that purpose. If the legislature does not appropriate money specifically for that purpose, HHSC may, but is not required to, implement a provision of the bill using other appropriations available for that purpose. The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.

The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.

prescription drugs for their employees, employees' dependents, and

retirees from vendors at a discounted rate or under terms the

comptroller negotiates.

(b) The prescription drug purchasing pool does not

constitute a risk pool, and each health benefit plan issuer,

qualified public employer, and qualified private employer

participating in the pool is responsible for paying the cost of a

claim or prescription drug in accordance with any applicable health

benefit coverage agreement with their employees, employees'

dependents, and retirees.

Sec. 446.003. ADMINISTRATION OF PRESCRIPTION DRUG

PURCHASING POOL. The comptroller by rule shall establish

Sec. 446.004. OPTIONAL STOP LOSS COVERAGE. The comptroller

shall provide a participant the option to purchase stop loss

coverage from an insurer at a rate the comptroller negotiates.

PURCHASING AGREEMENTS. (a) Two or more participants may jointly

purchase through the prescription drug purchasing pool

prescription drugs for their employees, employees' dependents, and

under this section does not constitute a multiple employer welfare

arrangement, as defined by Section 846.001, Insurance Code.

Sec. 446.006. RULES. The comptroller shall adopt rules as

necessary to implement this chapter.

SECTION 2. As soon as practicable after the effective date

of this Act, the comptroller of public accounts shall establish the

prescription drug purchasing pool as required by Chapter 446,

Health and Safety Code, as added by this Act.

SECTION 3. This Act takes effect September 1, 2025.
