Bill text, introduced version (I)

The bill builds stricter notice rules, then says skipping the notice does not undo the rule or any action under it. That leaves the new duty with no built-in consequence when an agency ignores it.

Summary

Individual e-mails naming the authorizing bill. Skip one and the rule still stands.

The bill tightens how state agencies must notify certain people, under an existing notice law, when the agency proposes a rule. Each notice must be sent individually to the recipient's Capitol e-mail or another e-mail they gave the agency, name the bill number that authorized the rule, and link or attach the proposed rule when practicable. Agencies can no longer count a mass e-mail list or a group e-mail as notice, but a rule still stands even if the agency never sends the notice.

AN ACT

relating to the notice of rulemaking proceedings provided to

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 2001.0261, Government Code, is amended

by amending Subsections (c) and (d) and adding Subsection (e) to

read as follows:

(c) A [ The ] state agency shall provide the notice required

under Subsection (b) electronically to the recipient's [ person's ]

designated Capitol e-mail address or to another e-mail address

provided by the recipient [ person ] to the agency for the purpose of

receiving the notice. The notice must:

(1) be specifically addressed and directed to the

recipient;

(2) include the bill number for the legislation that

enacted the statutory authority under which the proposed rule that

is the subject of the notice is to be adopted; and

(3) if practicable, provide a link to the proposed

rule that is the subject of the notice or include a copy of the

proposed rule as an attachment to the notice.

(d) A state agency may not provide the notice required under

Subsection (b) to a recipient by:

(1) including the recipient on an e-mail list service

the agency uses to provide periodic announcements of the agency's

proposed rules to members of the public or the legislature

or after the effective date of this Act.

SECTION 3. This Act takes effect September 1, 2025.
