…“this chapter applies only to an operator who provides swim instruction to a group of three or more students at one time”
Bill text, introduced version (I)
The safety, training, and background-check rules reach only group classes of three or more children. One-on-one and two-child lessons, and lessons run by cities and other local governments, fall outside the chapter. The core case of a private swim school teaching groups stays covered, so this is a partial gap, not a total escape.

Summary
One-on-one and two-kid lessons are exempt. So are city-run ones. Penalties reach $500 a day.
The bill creates a state license for businesses that teach swimming to children under seven, run by the Texas Department of Licensing and Regulation, which sets fees, safety rules, and training standards. It covers companies with two or more employees that teach groups of three or more young children at once, and it exempts licensed youth camps, licensed child-care facilities, and local governments. Starting September 1, 2026, covered swim schools need a license, certified instructors, background checks on staff, serious-incident reports, and must follow state safety rules, with administrative penalties of up to $500 per day for violations.
