Summary

The agency can’t punish a skipped scan until September 1, 2027, after the 2026 election.

The bill requires sellers to scan the electronic strip or code on a driver's license or state ID before selling alcohol to go, and makes failing to do so a Class A misdemeanor offense. It covers off-premises sellers such as convenience and grocery stores, but exempts package stores, restaurants, mixed beverage permit holders, makers' premises, stadium and festival events, delivery drivers and outdoor curbside pickup. The state agency cannot punish sellers for not scanning until sales made on or after September 1, 2027, and sellers get a defense for internet outages or buyers age 40 or older, a shield when the scanner approves a fake ID, and a ban on keeping the scanned data.
